AI Skin Analysis Terms of Use & Liability Waiver

1. Nature of the Service (Non-Medical) The IHENS GlowBox AI Skin Analysis tool ("The Tool") uses artificial intelligence and computer vision algorithms to analyze visual skin attributes based on the images and data provided by the user.

  • No Medical Advice: The Tool is strictly for informational, educational, and shopping assistance purposes. It does not constitute medical advice, diagnosis, or treatment. It is not a substitute for a consultation with a certified dermatologist or physician.

  • No Telehealth Relationship: Use of The Tool does not create a doctor-patient relationship between you and IHENS GlowBox or any of its affiliates.

  • Condition Identification: When The Tool identifies terms such as "acne," "wrinkles," or "pigmentation," these are descriptive visual tags for product categorization only, not clinical pathological diagnoses.

2. Technology Limitations & Accuracy You acknowledge that AI technology is experimental and evolving. The analysis provided is a probability-based estimation, not a certainty. The accuracy of the results is heavily dependent on the quality of the input provided by you. IHENS GlowBox is not responsible for inaccurate analysis caused by:

  • Poor lighting conditions (shadows, low light, or over-exposure).

  • Low-resolution camera quality.

  • Presence of makeup, filters, glasses, or hair obscuring the face.

  • Transient skin conditions (e.g., temporary redness from heat or exercise).

  • Device-specific color calibration differences.

3. Product Recommendations & Efficacy The product recommendations generated by The Tool are based on general matching logic between identified skin attributes and our product catalog (e.g., K-Beauty, J-Beauty formulations).

  • No Guarantee of Results: We do not guarantee that recommended products will cure any skin condition or achieve a specific aesthetic result. Skincare is highly individual; what works for one user may not work for another.

  • Ingredient Suitability: The AI does not know your personal allergy history. It is your sole responsibility to review the full ingredient list of any recommended product for potential allergens (e.g., snail mucin, bee venom, ferments, specific preservatives) before purchase.

4. Assumption of Risk & Mandatory Patch Testing By using The Tool and purchasing recommended products, you assume full responsibility for any skin reactions.

  • Mandatory Patch Test: You agree to perform a patch test on a small area of skin (such as the inner arm) 24 hours prior to full facial application of any new product.

  • Adverse Reactions: IHENS GlowBox explicitly disclaims liability for any adverse reactions, including but not limited to: breakouts (purging), irritation, redness, burns, or allergic reactions resulting from the use of products recommended by the AI.

5. Data Privacy & Image Processing

  • Processing Consent: By uploading your photo, you explicitly consent to the biometric processing of your facial image for the sole purpose of generating a skin analysis.

  • Data Retention: Your facial images are processed in real-time and are permanently deleted immediately after analysis." OR "Your facial images are stored securely for a limited period to allow you to track your skin progress and are not sold to third parties."]

  • Third-Party Processing: You acknowledge that data processing may be performed by third-party AI providers or cloud servers securely integrated into the IHENS GlowBox platform.

6. Limitation of Liability To the fullest extent permitted by applicable law, IHENS GlowBox, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • The use or the inability to use the AI Skin Analysis tool.

  • Reliance on any content or recommendation obtained from the Tool.

  • Any unauthorized access to or alteration of your transmissions or data.

7. Age Restriction The Tool is intended for use by individuals aged 18 or older. If you are under 18, you represent that you have obtained parental consent to use this feature and disclose your image.
